Terms of Use & Sales
Last updated: 28 August 2026
Welcome to the website and online store operated by Jacki McNab ("I", "me", "my" or "Jacki McNab").
These Terms of Use & Sale ("Terms") apply to your use of this website and to any purchase you make through the website.
By using this website or placing an order, you agree to these Terms. If you do not agree with them, please do not use the website or place an order.
1. About the website
This website is operated by Jacki McNab for the purpose of providing information about my books and related work and for selling my books and other products.
I reserve the right to update, modify or discontinue any part of the website at any time. I will not be liable if the website is temporarily unavailable due to maintenance, technical issues or circumstances outside my reasonable control.
2. Eligibility
You must be legally capable of entering into a binding agreement to purchase products through this website.
If you are under the age of 18, you should only place an order with the involvement and consent of a parent or guardian.
3. Products
I take reasonable care to ensure that product descriptions, photographs, prices and other information on the website are accurate.
However:
colours and images may appear differently depending on your device or screen;
minor differences may occur between photographs and the physical product; and
errors or omissions may occasionally occur.
If I discover a significant error in the description, price or availability of a product you have ordered, I will contact you as soon as reasonably practicable.
4. Prices
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
Prices may change from time to time. Any change will not affect an order that I have already accepted, except where a correction is required because of an obvious pricing error.
Unless otherwise stated, shipping and delivery charges are additional to the product price and will be displayed during checkout.
5. Placing an order
When you place an order through the website, you are making an offer to purchase the products selected by you.
After you place an order, you should receive an order confirmation.
An order confirmation does not necessarily mean that I have accepted your order. I may need to contact you if there is an issue with your order, including an availability, pricing or payment issue.
A contract for the sale of a product is formed when I accept your order and confirm that the product will be supplied.
I reserve the right to refuse or cancel an order where reasonably necessary, including where:
a product is unavailable;
there is an obvious pricing or description error;
payment cannot be processed;
I reasonably suspect fraudulent or unauthorised activity; or
circumstances outside my reasonable control prevent me from fulfilling the order.
If I cancel an order after you have paid, I will provide a refund of the amount you paid for the cancelled order.
6. Payment
Payment must be made using one of the payment methods available at checkout.
Payment information is processed through the relevant payment provider. I do not generally have access to or store your complete credit or debit card details.
An order will generally not be dispatched until payment has been successfully received.
7. Delivery
I will arrange delivery to the address provided by you at checkout.
You are responsible for ensuring that your delivery information is accurate and complete.
Estimated delivery timeframes are provided as a guide only and may vary depending on the destination, delivery service and circumstances outside my control.
For further information, please see my Shipping & Returns Policy.
8. International orders
If I offer delivery outside Australia, additional delivery charges, taxes, customs duties or other fees may apply.
Unless expressly stated otherwise, any customs duties, import taxes or similar charges imposed by the destination country are the responsibility of the customer.
You are responsible for ensuring that the product you order can legally be imported into your country.
9. Returns, refunds and consumer guarantees
My returns and refunds process is described in my Shipping & Returns Policy.
Nothing in these Terms limits, excludes or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot legally be excluded.
Where a product has a problem covered by a consumer guarantee, you may be entitled to a repair, replacement or refund, depending on the circumstances and the rights provided by law.
The fact that I do not offer a change-of-mind return does not affect your statutory rights.
10. Change-of-mind returns
Unless otherwise stated in my Shipping & Returns Policy, I am not required to accept returns simply because you have changed your mind, selected the wrong product or no longer want the book.
However, I may choose to accept a change-of-mind return at my discretion, subject to any conditions communicated to you.
This does not affect your rights under the Australian Consumer Law.
11. Damaged, faulty or incorrect products
If your book arrives damaged, defective or different from what you ordered, please contact me as soon as reasonably practicable.
I may ask you to provide photographs or other information to help me assess the issue.
Where the product is covered by a consumer guarantee or I otherwise agree that a remedy is appropriate, I will provide an appropriate remedy in accordance with applicable law.
12. Intellectual property
Unless otherwise stated, all content on this website is owned by or licensed to Jacki McNab.
This includes, where applicable:
book excerpts;
written content;
photographs;
graphics;
logos;
artwork;
designs;
videos;
audio;
trademarks and branding; and
other original material.
You may access and use the website for your personal, non-commercial purposes.
You must not reproduce, republish, distribute, modify, sell or commercially exploit website content without my prior written permission, except where permitted by law.
Purchasing a physical copy of my book does not transfer copyright or other intellectual property rights to you.
13. Reviews and user content
If the website allows you to submit reviews, comments, photographs or other content, you are responsible for ensuring that your contribution is lawful and does not infringe another person's rights.
By submitting content to the website, you grant me a non-exclusive, royalty-free licence to use, reproduce and display that content for purposes connected with operating and promoting my business, subject to applicable law.
I reserve the right to remove content that I reasonably consider inappropriate, unlawful, misleading, offensive or unrelated to the website.
14. Links to other websites
The website may contain links to third-party websites.
These links are provided for convenience only. I do not control and am not responsible for the content, security, availability or privacy practices of third-party websites.
You should review the terms and privacy policies of third-party websites before using them.
15. Website security and acceptable use
You must not knowingly:
introduce malicious software or code;
attempt to gain unauthorised access to the website;
interfere with the website's operation;
use the website for fraudulent or unlawful purposes;
scrape or systematically copy website content without permission; or
use the website in a way that could damage or disrupt it.
16. Limitation of liability
To the maximum extent permitted by law, I will not be liable for loss or damage arising from your use of the website where that loss or damage results from circumstances outside my reasonable control.
Nothing in these Terms excludes, restricts or modifies any liability, guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
17. Events outside my control
I will not be responsible for delays or failure to perform my obligations where caused by circumstances beyond my reasonable control.
This may include natural disasters, severe weather, fire, flood, epidemic or pandemic, industrial disputes, transport disruptions, postal disruptions, internet or technology failures, government action or other events beyond my reasonable control.
Where reasonably possible, I will notify you of significant delays and take reasonable steps to minimise their effect.
18. Privacy
My collection and handling of personal information is explained in my Privacy Policy.
By using the website, you acknowledge that personal information may be collected and handled as described in that Privacy Policy.
19. Changes to these Terms
I may update these Terms from time to time.
The updated version will be posted on this website with a revised "Last updated" date.
Changes will not retrospectively alter the terms applying to an order that I have already accepted, except where required by law.
20. Governing law
These Terms are governed by the laws of Queensland, Australia.
You agree that disputes relating to these Terms or your use of the website will be subject to the courts and laws applicable in Queensland, subject to any mandatory rights you may have under applicable consumer protection laws.
